The U.S. Equal Employment Opportunity Commission – a federal agency that enforces civil rights laws – recently released new guidance, saying workplace bias laws apply to bathrooms, pronouns, and abortion. The guidance is not legally binding, but creates a new outline for how the federal agency would enforce workplace bias laws.
The new guidance – the first update in 25 years – is a big step for LGBTQ+ protections, and says it is unlawful for employers to refuse to use transgender workers’ preferred pronouns or prevent them from using bathrooms matching their gender identity.
The guidance also says any discrimination against employees because of their reproductive decisions – including whether or not to have an abortion – is an unlawful form of sex discrimination.
