On January 11, 2017 the Kennedy Hunt, P.C., III, filed a Motion for Preliminary Injunction requesting the District Court issue an order preventing the City of Springfield from evicting our clients, a group of individuals with disabilities, during the pendency of the fair housing lawsuit filed by our office on December 22, 2016. After successful oral argument by Thomas Kennedy, Judge Richard Mills granted the preliminary injunction, which prevented the City of Springfield from enforcing its discriminatory zoning ordinance that prevents individuals with disabilities from living together as a family if they are located within 600 feet of another home housing individuals with disabilities. This decision allows our clients to stay in their home during the course of litigation instead of facing immediate institutionalization.
