On March 31, 2025, Kennedy Hunt P.C. filed a complaint against FedEx Freight, alleging that the company terminated our client due to his disability, retaliated against him for accessing FMLA leave during his employment at FedEx, and interfered with his right to take FMLA leave. 

According to the lawsuit, our client was employed by the defendant, FedEx, for 13 years, from 2010 to 2023. During his employment, our client was diagnosed with severe arthritis. The lawsuit states that in about 2019 and again in 2020, Plaintiff properly requested and was granted intermittent and continuous FMLA leave following hip replacement and knee replacement surgery, respectively. 

The lawsuit further alleges: 

As of late 2023, Defendant was aware that Plaintiff was likely to need another hip replacement due to Plaintiff’s arthritis. On or about December 5, 2023, Defendant terminated Plaintiff’s employment

According to the lawsuit, FedEx terminated our client’s employment because he reported his ‘delay time’ incorrectly. “Delay time” is pay received by drivers for the period of time they must wait for their trucks to be loaded and hitched up, and their dispatch paperwork to be completed. Our client claims he entered his delay pay in the same manner the entire time he was employed by the Defendant, for approximately 13 years.

The lawsuit alleges: “Plaintiff’s disability of arthritis was a motivating factor in Defendant’s actions against Plaintiff. Defendant’s actions constituted disability discrimination in violation of the Missouri Human Rights Act.”

The lawsuit seeks lost wages and benefits, emotional distress, liquidated damages, attorneys’ fees, and costs of litigation.
